The DIFC Court’s decision in 𝗙𝗔𝗟 𝗢𝗶𝗹 𝗖𝗼𝗺𝗽𝗮𝗻𝘆 𝘃. 𝗦𝗵𝗮𝗿𝗷𝗮𝗵 𝗘𝗹𝗲𝗰𝘁𝗿𝗶𝗰𝗶𝘁𝘆 𝗮𝗻𝗱 𝗪𝗮𝘁𝗲𝗿 𝗔𝘂𝘁𝗵𝗼𝗿𝗶𝘁𝘆 (𝗦𝗘𝗪𝗔) redefined the scope of sovereign immunity in the UAE.

𝗞𝗲𝘆 𝗟𝗲𝗴𝗮𝗹 𝗙𝗶𝗻𝗱𝗶𝗻𝗴𝘀:

The court referred to 𝗔𝗿𝘁𝗶𝗰𝗹𝗲 𝟵𝟵 of the UAE Constitution, which assigns jurisdiction to the Union Supreme Court for resolving disputes between emirates, indicating that there is no blanket inter-emirate immunity

The court asserted that entities created for commercial purposes are generally presumed not to be entitled to sovereign immunity. FAL Oil’s dealings with SEWA were commercial, denying sovereign immunity claims for commercial activities

The ruling established that judgments from other UAE courts could be recognized and enforced within the DIFC Courts. This was significant as it provided a pathway for creditors to enforce judgments against state-owned enterprises like SEWA, which had previously been challenging due to claims of immunity.
